For products and services that use AI, the terms of the written agreement (contract) on liability, terms of use, warnings and notices, costs, and compensation are just as effective as the human counterparts.

But many advanced uses of AI can check the limits of existing laws and, under existing legal frameworks, gain some productivity for new patterns of responsibility. Companies seeking to assess the legal risk posed by the implementation of AI must adopt a holistic approach to accountability and responsibility for the degree to which the AI system intends and the performance of the algorithm.

A careful auditing method is important to establish the reliability associated with the quality of the AI system. The workplace of the United Kingdom Information Commissioner is to identify five risk areas for analysis and reflection in AI decisions:

  • Significant human reviews in non-machine-driven AI systems.
  • Accuracy of the system output and performance.
  • Security risks associated with AI.
  • Explanation of AI-based decisions.
  • Bias and discrimination in the AI.

Liability for Data

Lastly, you are also answerable for the data you use in your AI model. Incorrect or incomplete data may lead to inaccurate decision-making. Further, similar data can also lead to biases in the system. For smart algorithms to run according to expectation, it is important that you provide extensive information covering different scenarios. Moreover, your algorithms should also be in accordance with privacy laws.  Therefore, AI systems should not only be working properly but also avoiding any security breaches.

The issue of AI’s liability is as comprehensive as its use cases. In many cases, AI is straightforward and does not cross the set liability thresholds.  However, complex systems will require careful thinking and legal analysis. Corporations should also be concerned with the various policies that are present in order to identify appropriate parameters for AI use.
